Getting hit by a car...what a lovely thing...

Walking across the street on my way back from lunch...(looking both ways, yes)...and next thing I know, there's a car barreling down on me. I get knocked down, with a huge-ass abrasion across my whole hip, a skinned hand, and what's the first thing the driver sez to me when he stops? "Yo, who's gonna pay for that dent in my car now?"

::smack::...dumbass...

Hrm...well did you cross at the crosswalk first of all? If so was the light green? If so did he come through a red light? If not was he driving quickly?

I have a feeling you can sue him. (too much torts not enough sleep)

No crosswalk, no traffic light anywhere...it's in a college campus...the crossing's just used a lot by students...so yeah, I guess its kinda my fault too...

Yes, you're brakes should be able to stop you within 3 feet of the person. Its a commonly known fact

Well the good news is that even if you were contributorily negligent you can still collect damages, just not as much as you would have if it was completely the driver's fault.

Did you mean that the street was clear, and you started walking and then halfway across it just appeared? Or were you just too lazy to look around until it was too late? Because if the first one was the case, then the driver should have seen you but probably wasn't paying attention (his fault), and if it was the second then it was partially your fault...
