last night i was out a party, had a few drinks, then later on after the party ended around 12:30 ish, i went for a cruise with my mate down to the local macca's to meet up with a few mates.

around 2am, we decided to head home, and since i was on my Learner's Permit and needing the lessons, (over here in Oz you need to complete 50 hours worth of driving), i took the wheel.

i'd had 3 375ml cans of white label Beam & Cola in between 8pm and 10:30pm, and was still sober. it had been almost 4 hours since i had the drinks, so i thought i'd be under the limit.

I was later pulled over by Highway Patrol, because i stressed out and stalled the engine when i drove past at the intersection. I was later submitted to 2 breathalisers, which they didnt give me a reading for.

i was placed under arrest, taken to the station, and took a third test, which gave a reading of .04

i thought everything was cool coz the national limit is .05, but turns out learners have a BAC limit of .02 so i was well over.

had my photo taken, prints done, signed documents, and then later released me.

i've gotta appear in juvenile court on the 30th, and i was wondering if there is any legal advice i can get regarding this matter.

The limit here for BAC is .00. That is unless you are over 21. Then it's like .08 for DUI and .10 for DWI.

Any chance you could get a diversion? Here in the states if you have a clean record you can get into a diversion program.

Basically, you take some stupid class (pay extra $$) and pay some other fees, do some community service and they put the infraction on hold. You keep your ass clean for a certain period (usually 1 year?), and don't get in trouble again, then they'll take it off of your permanent record.

Call the local prosecutor's office/courthouse or a lawyer and see if they have anything like that and if you have a chance.

well since im only 17, im classed as a juvenile, which means when i turn 18, my juvenile record is wiped.
im concerned bout the fine more than anything.

im just concerned to as why they didn't tell me my first and second tests? could i use that to support myself in anyway?

im planning on getting references to provide so i can prove i have a good character, etc, not a trouble maker.

Make a good impression (i.e. don't show up in jeans), references might help. Plead guilty. Don't get angry. Show regret. Give them the idea that you are the reasonable, intelligent guy you actually are, so they will think that it was really just once that this happened, and is never likely to happen again. Don't argue with them. Accept that you are guilty and that you will get some sort of punishment, show that you are really sorry, and you should get out with the smallest fine possible.

Ok, strap it all to your chest under a light jacket. Now if you wait 'till the end there may be no need but consider this your "contigency plan". If the verdict doesn't work out you can threaten them down to a plea bargen maybe even an acquittal, I saw "double Jepardy" like 15 times and if it works for Ashley Judd i don't see why it won't work for you.

Tell the judge that you were practicing driving drunk so that if you were ever really driving drunk you would be expirienced.

That would be incorrect. In maryland, dc and VA under 21 is allowed a .02 BAC to allow for the small amounts of alcohol in cough syrups and such.
