Getting hit by a car...what a lovely thing...

Walking across the street on my way back from lunch...(looking both ways, yes)...and next thing I know, there's a car barreling down on me. I get knocked down, with a huge-ass abrasion across my whole hip, a skinned hand, and what's the first thing the driver sez to me when he stops? "Yo, who's gonna pay for that dent in my car now?"

::smack::...dumbass...

Hrm...well did you cross at the crosswalk first of all? If so was the light green? If so did he come through a red light? If not was he driving quickly?

I have a feeling you can sue him. (too much torts not enough sleep)

No crosswalk, no traffic light anywhere...it's in a college campus...the crossing's just used a lot by students...so yeah, I guess its kinda my fault too...

Yes, you're brakes should be able to stop you within 3 feet of the person. Its a commonly known fact

Well the good news is that even if you were contributorily negligent you can still collect damages, just not as much as you would have if it was completely the driver's fault.

Then you should have been watching him on the side of the road, aware that he might run out. Pedestrians have the right of way.

Did you mean that the street was clear, and you started walking and then halfway across it just appeared? Or were you just too lazy to look around until it was too late? Because if the first one was the case, then the driver should have seen you but probably wasn't paying attention (his fault), and if it was the second then it was partially your fault...

what i meant, was, what if you didnt see the person because he/she walked out from behind a car or a building or something.

I looked both ways before and saw it was clear...laziness kinda doesnt factor into it, it's just stupid not to look...and no I didnt "forget", Drew. Clearance for maybe 100 ft, which equates to about 3 secs at the speed limit. Now I'm wondering what speed he musta been going at that I'm still walking, but dented his car...

Pedestrians have the right of way like 99\% of the time. There are very few places besides the highway/interstate where pedestrians do not have the right of way. Plus I imagine your insurance goes WAY up after hitting a pedestrian.

Must have been in a suburban/rural area, where car culture reigns supreme. Walking places is rarely done. In a more urban setting, most drivers are aware of people crossing the road at odd places.
