If you named your kid a copyrighted name could they or you be prosecuted? Like this is our son Metallica and our daughter Sony. As crazy as shit is now, like with blizzard sueing over the name diablo, and the whole napster shit I really dont know how it would play out.------------------ http://www.technicalvirgin.com/ Posted by DuSTman on Apr. 01 2001,13:47

Awesome. From now on im calling myself Microsoft. And as long as I dont become a man whore itll be legal. It interferes with my retirement plan but I think im better off.

As long as you aren't selling your kid or making profit from his name then you aren't going to be sued. I saw not to long ago that either Victoria's Secret or Fredrick's of Hollywood came out with a nailpolish called Mettalica. And some hotel called itself Hotel California. Come on people... You are just begging to be sued.------------------ Posted by solid on Apr. 01 2001,21:47

isn't that like the "I'm gonna write an unauthorized autobiography and sue myself for plagurism" thing?... Well, not really, but funny idea...------------------ Sometimes you're the dog, sometimes you're the hydrant... Posted by whiskey@throttle on Apr. 02 2001,00:01
quote: No. Your legal birth name is yours. However, if you change your name to a previously copyrighted trademark or registered tradename, with the sole intent of fradulently representing said copyright, then you may find yourself in a legal mess. I don't know what the outcome of such a trial would be, but you'd undoubtedly find yourself served to court. Nevertheless, historically, names have legally been the right of the person who bears the name. Here's an example: McDonald's (McDonald's Co., et al) tries to sue Joe McDonald, who opens a restaurant named McDonald's Eatery. The later McDonald emerges victorious, because he based his company name on his own surname, which dates back to the 17th century. An interesting addition: the first amendment also plays a role in this. Some have defended their right to a name via the freedom of religion ("this is my God-given name, etc etc"). Oh, have you ever heard about the lady who named her kids Orangejello and Lemonjello? It's a true story, and I'm really not making it up...though you may choose not to believe me due to my less-than-credible track record here on det.net. Poor kids. AFAIK a trademark is only protected in a certain context. For example Blizzard OWN Diablo in the contexts of games and movies specifically. They specified that. If I was to change my name to Diablo, they couldn't do anything.Same for Metallica. I mean if you brought out a nail polish, that would be ok, but if you used their logo, etc, that's infringement. There ya go. Mike PS. IANAL ------------------ Posted by just_dave on Apr. 07 2001,01:51
whats a small copyright infringement between frieds right???------------------ Posted by z3r0 c00l on Apr. 07 2001,18:37

i think some or most of our names come from something that has influenced us in our lives. its just that some are more obvious than others..mine is from a book. but you dont flame me for that, because its not apparent to you. besides, why dont you give him a chance, me and him are best friends (him being z3r0_c00l)------------------ |
