last night i was out a party, had a few drinks, then later on after the party ended around 12:30 ish, i went for a cruise with my mate down to the local macca's to meet up with a few mates.around 2am, we decided to head home, and since i was on my Learner's Permit and needing the lessons, (over here in Oz you need to complete 50 hours worth of driving), i took the wheel. i'd had 3 375ml cans of white label Beam & Cola in between 8pm and 10:30pm, and was still sober. it had been almost 4 hours since i had the drinks, so i thought i'd be under the limit. I was later pulled over by Highway Patrol, because i stressed out and stalled the engine when i drove past at the intersection. I was later submitted to 2 breathalisers, which they didnt give me a reading for. i was placed under arrest, taken to the station, and took a third test, which gave a reading of .04 i thought everything was cool coz the national limit is .05, but turns out learners have a BAC limit of .02 so i was well over. had my photo taken, prints done, signed documents, and then later released me. i've gotta appear in juvenile court on the 30th, and i was wondering if there is any legal advice i can get regarding this matter.

The limit here for BAC is .00. That is unless you are over 21. Then it's like .08 for DUI and .10 for DWI.

plead guilty, unfortunately.you'll probably end up with 6 months to wait to get your permit again. Posted by Beldurin on Aug. 11 2001,04:18
Any chance you could get a diversion? Here in the states if you have a clean record you can get into a diversion program.Basically, you take some stupid class (pay extra $$) and pay some other fees, do some community service and they put the infraction on hold. You keep your ass clean for a certain period (usually 1 year?), and don't get in trouble again, then they'll take it off of your permanent record. Call the local prosecutor's office/courthouse or a lawyer and see if they have anything like that and if you have a chance. Good luck! ------------------ quote: Never argue with and idiot...he may be doing the same thing Posted by Neophyre on Aug. 11 2001,04:42
well since im only 17, im classed as a juvenile, which means when i turn 18, my juvenile record is wiped.im concerned bout the fine more than anything. im just concerned to as why they didn't tell me my first and second tests? could i use that to support myself in anyway? im planning on getting references to provide so i can prove i have a good character, etc, not a trouble maker.

Make a good impression (i.e. don't show up in jeans), references might help. Plead guilty. Don't get angry. Show regret. Give them the idea that you are the reasonable, intelligent guy you actually are, so they will think that it was really just once that this happened, and is never likely to happen again. Don't argue with them. Accept that you are guilty and that you will get some sort of punishment, show that you are really sorry, and you should get out with the smallest fine possible.Good luck, man. Get a dozen or so road flares, some wire, a thing of elctrical tape, and a garage door opener...Ok, strap it all to your chest under a light jacket. Now if you wait 'till the end there may be no need but consider this your "contigency plan". If the verdict doesn't work out you can threaten them down to a plea bargen maybe even an acquittal, I saw "< double Jepardy >" like 15 times and if it works for Ashley Judd i don't see why it won't work for you. Warning do not try this at home^ [EDIT- another briliant idea] Tell the judge that you were practicing driving drunk so that if you were ever really driving drunk you would be expirienced. quote: That would be incorrect. In maryland, dc and VA under 21 is allowed a .02 BAC to allow for the small amounts of alcohol in cough syrups and such. ------------------ Posted by RenegadeSnark on Aug. 11 2001,13:01

Also - driving stoned is much safer than driving drunk. Keep that in mind.

well seeing as the only difference being that with pot you KNOW you're out of it. other than that i wouldnt say its any safer------------------ quote: < Where's your self re-cocking-spect > Posted by Dark-Angel99 on Aug. 11 2001,17:42
Next time don't drive even if you had a drink of beer!! That's so dangerous! My friend died because he was driving drunk and I hate to see people follow in his footsteps! ------------------ Posted by CatKnight on Aug. 11 2001,18:35

in CA it's .00 if you're a minor - hence the name "Zero Tolerance."Mr. Snark, I agree with you to an extent. Driving while moderatlely high isn't much of a risk. Driving if you're totally crippled is different - but when you're that high you don't want to drive anyway Neophyre, I don't know anything about Australian law. Here in the US you'd be fux0red - your permit would be taken away and you'd be walking until you were 21. Posted by incubus on Aug. 12 2001,05:46
quote: that's a dumb thing to say ... i know you advocate pot and in a lot of cases so do i, but driving on either of those is fucking stupid! alcohol impairs judgement but your reactions go all over the place on pot. it's a lose-lose battle. don't get wrecked if you're gonna drive. we're not putting a man on the moon here. You will get your license suspended man. It may only be 3 months for your first offence too. I'm on the gold coast, and it just happened to my mate just recently. The reason they didn't give you the first readings is coz they didnt want to book you, but the reading was too high to let you go, thats why they came back.Btw, there is more than one standard drink in a can of white label, and your body can do 1 standard drink an hour... and thats to keep you under .05 Posted by Beldurin on Aug. 15 2001,03:49
quote: Not necessarily. It's possible that your BAC wasn't quite high enough on the first reading, but was close and the second was higher (rising b/c of more alcohol entering the bloodstream from the stomach). So they may have just been waiting it out until they could bust you. Sounds far-fetched and kind of paranoid (and I'm not paranoid, really), but it happened to a friend of mine. I have to go now...the black helicopters are circling my house again... ------------------ quote: Never argue with and idiot...he may be doing the same thing Posted by ic0n0 on Aug. 15 2001,03:51
In the state of Wisconsin (this is not bullshit ive done it and so do most people here) if you are under the age of 18 you can drink alcohol as long as you are with a parent or legal guardian and they are with you as long as the alcohol is in your system, but between the ages of 18 and 21 you cannot drink at all under any circumstances. As for being intoxicated that is illegal no matter your age and under any circumstances. I think the legal blood alcohol levels for D.U.I and the like are close to the national average. Wisconsin was the last state to change the drinking age to 21, and we did that under a threat from the federal government.------------------ |
